Trials are designed to separate the innocent from the guilty, but they sometimes do both less and more than that. Fallible jurors might free the guilty or convict the innocent. Flawed procedures sometimes obscure the truth. Prosecutors might withhold exculpatory evidence or undervalue its significance. Things can go wrong in trials. We will try to understand why and imagine what can be done to improve trial results. Great trials are windows into history. The multiple perspectives on events offered by witnesses and attorneys, the richness and specificity of testimony, and the central focus on truth-finding all combine to make trials unique and valuable tools for historical understanding. It is not necessary to have taken the first course in this series to participate and enjoy this continuation course.
